1) General Information

For an order on the Internet at ASTRA Cosmetics GmbH (hereinafter referred to as “ASTRA”), under www.swiss-cream.shop only the following GTC apply in the version valid at the time of the order. Any deviating terms and conditions of the customer are not recognized by ASTRA. All questions or complaints relating to these GTC or the underlying contracts are to be addressed to:

2) Conclusion of the Contract

You can choose from the assortment of the online shop of Swiss cream goods and coupons and collect them in a shopping cart via the button “add to Cart”. By sending us an order by clicking on the button “Buy Now”, you provide a binding offer to purchase the goods or vouchers collected in the shopping cart. Before sending the order, you can change and view the data at any time. Changes can be entered via the button “edit” in the context of the order overview at the end, the order process and saved for the order process.

Upon receipt of the order, we will send you an automatic e-mail confirming the receipt of the order and listing the details of the order. This acknowledgement of receipt does not constitute acceptance of the offer, but only informs you that the order has been received by us.

The contract of sale is only concluded by the dispatch confirmation sent to you by means of separate e-mail (for voucher orders by the transfer of the voucher by e-mail). If we are not able to deliver the ordered goods or the voucher without our own fault, for example because suppliers do not fulfil their contractual obligations to us and/or not in time, we are not responsible for the delivery and may refuse acceptance accordingly. A contract was not concluded. We will inform you immediately about the non-formation of the contract as well as the non-delivery and refund any payments already made to you.

Should the information on the assortment of goods (e.g. price etc.) in the online shop be wrong despite careful examination by us, we declare by sending the goods, stating the correct information, no acceptance, but a new offer, on whose acceptance you freely Can decide.

The contract text is saved. The contract language is German. After the order has been completed, you can view the contract in your customer profile on www.swiss-cream.shop  if you have registered as a customer or logged in as a registered customer when ordering. In addition, the order data, the cancellation policy, the invoice as well as our general terms and conditions are also sent to you with the shipping confirmation. 4) Delivery and availability of goods

The goods are delivered as shown in the online shop, whereby we reserve minor deviations in the packaging. Delivery is made to the delivery address indicated by the customer.

The delivery time for shipping within the Republic of Austria is 3-4 working days. Delivery times outside the territory of the Republic of Austria in the EU area is approximately 5 – 6 working days.

 

5) Minimum/maximum order values

A minimum order value on goods does not exist. The minimum order value of a voucher is 10,– EUR, the maximum order amount of a value voucher 150,– EUR. Value vouchers can only be redeemed once.

 

6) Terms of payment

All prices are quoted in euros and include the legal value added tax and are subject to shipping costs. The price is valid at the time of the order.

Payment is made by credit card (MasterCard or Visa), PayPal, or instant transfer. Payment by sending cash or cheques is not possible.

With the payment methods PayPal and instant transfer, the debit of the purchase price is made from your account with successful completion of the payment process.

If you pay with a voucher, the value will be deducted from the voucher upon completion of the order.

 

7) Shipping

It is delivered within the Republic of Austria and the European Union.

For the delivery of goods within Austria we charge a flat-rate shipping fee of 10,– EUR per order, in the EU area shipping costs of 15,– EUR per order are charged.

In the case of voucher orders, you receive the coupon code by means of separate e-mail after confirmation of your order.

 

8) rescission Instruction

Withdrawal

You have the right to revoke this agreement within fourteen days without giving any reasons.

The period of withdrawal shall be fourteen days from the date on which you or a third party designated by you, who is not the carrier, has or has taken possession of the goods.

In order to exercise your right of withdrawal, you must inform us via one of the following contact paths by means of a clear statement of your decision to revoke this agreement. You can use the following sample withdrawal form, but this is not mandatory.

In order to maintain the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the end of the withdrawal period.

 

Consequences of revocation

If you revoke this agreement, we will provide you with all the payments we have received from you, including shipping costs (except for partial revocation and additional costs arising from the fact that you have a different type of delivery than that of us The cheapest standard delivery offered), immediately and at the latest within fourteen days from the date on which the notice of cancellation of this contract has been received by us. For this repayment, we use the same means of payment that you used in the original transaction, unless you have expressly agreed otherwise; In no case will you be charged for this redemption. To be sent back or transferred. Please refer to our information in Item 9 for return shipping. The time limit is respected if you send the goods before the expiry of the period of fourteen days. We bear the cost of returning the goods.

They only have to pay for any loss of value of the goods if this loss of value is due to a handling of them which is not necessary for the examination of the nature, properties and functioning of the goods.

 

9) Notes for the Return of goods

In case of revocation we will allow you a free return. Please note the following information for the return, which makes it easier for us to process:

1. Use the original packaging to return the goods.

3. Fill in the return slip and glue it to the package.
4. Send the package to the following address:

10) Cancellation

You have the option to cancel your order. A cancellation is possible up to the time the order is sent to our logistics. After receipt of the shipping confirmation by e-mail, cancellation is no longer possible. Your right of withdrawal is not affected by this.

11) Warranty

We stand for the highest quality of our products. Nevertheless, we ask you to check the delivered goods immediately with your order. If you find any obvious defects such as damage, breakage or missing quantities, please contact us immediately.

For all goods from our online shop there are legal warranty rights. However, personalised articles are only defective if they do not conform to the technical status of digital photo processing or have transport damage. Defectiveness due to different light and/or sharpness conditions to the original photo is excluded, as these are related to the image quality of the photos sent to us.

 

12) Retention of title

The delivered goods remain the property of ASTRA Cosmetics GmbH until the complete purchase price payment has been made.

 

13) Use of the stored data/data protection

Information about the nature, scope and purpose of the collection and storage of the personal data required for the execution of the sales contract, through ASTRA, can be found in the data protection declaration.

 

14) Limitation of liability

ASTRA shall be liable in the event of intent or gross negligence.

Furthermore, liability for a negligent breach of duty is excluded, unless there are breaches of essential contractual obligations, the breach of which endangers the achievement of the purpose of the contract or breaches obligations whose fulfilment is the proper Implementation of the contract is only made possible and the customer is familiar with it on a regular basis. In these cases, however, Beiersdorf’s liability is limited to the foreseeable, typical, contractual, direct average damage caused by the nature of the goods. The aforementioned limitations of liability do not concern claims of the customer from product liability as well as claims of the customer in the event of injury to life, body and health, in case of a warranty takeover by ASTRA or with fraudulently concealed defects.
